Bill Positions

Bill Number: HB 1235

Bill Title: Maryland Wage and Hour Law - Payment of Overtime - Exemptions

Bill Sponsor(s): Delegate Feldman, et al.

Subject: Employment Relations

Committee: ECM

Bill Summary: This bill exempts specified employers from the requirement to pay a specified wage for overtime; and alters the manner in which a wage for overtime is computed by employers for employees.

History: None

Chamber Position: Oppose

Position Summary: A daily overtime requirement would put Maryland at a significant competitive disadvantage with surrounding states. Every other state on the Eastern seaboard – in fact, every state east of the Mississippi -- requires only that overtime be paid after 40 hours are worked in a week. Should HB 1235 become law, Maryland employers would have significantly increased labor costs compared to employers in surrounding states.

HB 1235 is bad for Maryland business. It would place Maryland at odds with 45 of the other 50 states by requiring Maryland employers to pay substantially greater overtime then their counterparts.

For these reasons, the Maryland Chamber opposes this legislation.
